Terms of Service

These terms apply when you use anything provided by Pick Me Up (“PMU”, “we”, “us”): this website, a wallet ticket we issued, a check-in link, or the tour operator dashboard (together, the “Service”). By using the Service you agree to them.
Two kinds of people use the Service. Travelers hold a ticket for a tour and use it to check in at a pickup point. Operators are the tour companies that issue those tickets through PMU and manage pickups in the dashboard. Sections 2 and 3 are for travelers, sections 4 to 6 are for operators, and the rest applies to everyone.
1. What the Service is
PMU turns a booking made with an operator into a ticket for Apple Wallet or Google Wallet, delivers it by email, keeps it up to date, and lets the traveler check in at the pickup point by sharing their location. Operators see who has checked in, who has added their ticket to a wallet and where their pickup places are.
PMU is not a tour operator, a transport company or a travel agent. We do not sell tours, take payment for them or drive the bus. The tour itself, and everything about the booking, is provided by the operator under the operator’s own terms.
2. Travelers: your ticket
- Your ticket is issued on behalf of the operator you booked with. Your contract for the tour, including price, payment, changes, cancellation and refunds, is with that operator, not with us.
- The ticket shows the details we received from the operator's booking system. If something on it is wrong, contact the operator; we update the ticket when the booking is updated.
- The QR code and the check-in link are personal to your booking. Do not share, copy or alter them. Anyone with the link can check in as you.
- If the operator cancels or changes your booking, the ticket may be updated or withdrawn. A ticket on your phone is not proof that a booking is still valid; the operator's records are.
- Apple Wallet and Google Wallet are provided by Apple and Google under their own terms. We do not control how they store or display passes.
3. Travelers: checking in
- Online check-in is a convenience offered by the operator. It lets the operator see that you are at the pickup point. It does not guarantee a pickup, a seat, a departure time or that a bus will wait for you; those are matters between you and the operator.
- Check-in needs your location. Your browser asks for permission; you can decline, and your ticket still works when shown to the driver. How we handle location is described in the Privacy Policy.
- Check-in only succeeds when your phone reports that you are within a short distance of the assigned pickup point. GPS is not perfect, especially between buildings, so check in a few minutes early and keep the ticket ready to show.
- Do not spoof your location or check in from somewhere other than the pickup point. The operator may refuse a pickup that was checked in falsely.
- The map, directions and any live bus position are aids only. They rely on third-party maps and on tracking data the operator provides, and may be delayed or inaccurate.
4. Operators: accounts and access
- Dashboard access is granted per company. You are responsible for everyone who uses your company's accounts and for keeping sign-in details, booking-system keys and webhook secrets confidential.
- Tell us promptly if an account is compromised or a staff member who had access leaves.
- You must give us accurate company details and keep them current, including the sender address and logo used on tickets and emails, because customers see them.
- We may suspend an account that we reasonably believe is being misused or that puts the Service or other operators at risk.
5. Operators: your customers' data
When you connect your booking system to PMU, your customers’ booking details flow to us and we process them on your behalf, as described in the Privacy Policy. You are the data controller for that information, and you confirm that:
- You have a lawful basis to share it with us and to have tickets and emails sent to your customers.
- You have told your customers, in your own privacy notice, that you use a ticketing and check-in provider.
- You will pass on any request from a customer to access, correct or delete their data, and we will help you meet it.
- You will only instruct us to process data for running your tours and pickups, and only send us bookings for products you actually operate or resell.
In demo mode we generate tickets for your review without emailing customers. When you switch to live, every new confirmed booking triggers one “Add to Wallet” email to the customer from the sender you chose. Check that your booking details, pickup places and sender address are correct before going live; we send what your booking system gives us.
6. Operators: fees and availability
Fees, if any, are set out in the separate agreement between your company and PMU. Travelers never pay us anything.
We work hard to keep the Service running, but it depends on your booking system, on Apple and Google, on our hosting providers and on the traveler’s phone and network. We do not promise uninterrupted or error-free operation, and we may change, suspend or retire features (including features marked as beta or preview, such as live bus positions) with reasonable notice where practical.
7. Acceptable use
When using the Service, you must not:
- Forge, alter or reuse tickets, QR codes, check-in links or tokens, or try to check in for a booking that is not yours.
- Falsify your location or interfere with how the check-in decides whether you are at the pickup point.
- Access, probe or scrape the Service, its API or another company's data without permission, or try to get around access controls.
- Send us bookings, webhooks or requests that are fraudulent, malicious or intended to disrupt the Service.
- Use the Service in a way that breaks the law or infringes anyone's rights.
8. Third-party services
The Service relies on services we do not control: Apple Wallet, Google Wallet, the operator’s booking system, map providers, email and SMS delivery, and hosting providers. Their terms and privacy policies apply to their part of the experience. We are not responsible for their availability, changes or failures, but we will do what we reasonably can to work around them.
9. Intellectual property
The Service, its software, design and content belong to PMU or its licensors. Operators keep all rights to their own names, logos and booking data, and give us permission to use them only to provide the Service. You may not copy, modify, resell or reverse engineer the Service except where the law allows.
10. No warranty
The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises about its accuracy, reliability or fitness for a particular purpose. In particular, a check-in, a map, a distance shown on screen or a bus position is information to help you, not a guarantee.
11. Limitation of liability
To the extent the law allows, PMU is not liable for indirect or consequential loss, lost profits or lost bookings, or for missed pickups, missed tours or costs that result from a ticket, check-in, map or bus position being unavailable, delayed or inaccurate. Our total liability to an operator for anything connected with the Service is limited to the fees that operator paid us in the twelve months before the claim.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or the statutory rights of consumers.
12. Ending use of the Service
Travelers can stop using the Service at any time by deleting the ticket from their wallet. Operators can end their agreement with us as that agreement provides; we may end or suspend access if these terms are broken or if we discontinue the Service, with reasonable notice where practical. After an operator leaves, we delete or anonymise its customers’ data as described in the Privacy Policy.
13. Changes to these terms
We may update these terms as the Service develops. The date at the top shows the current version. Material changes will be announced on this page and, for operators, by direct notice. Continuing to use the Service after a change means you accept the new terms.
14. Governing law
These terms are governed by the laws of Iceland. Disputes are resolved by the courts of Reykjavík, Iceland, unless you are a consumer and the law of your country of residence gives you the right to bring a claim there.
